internal/ethapi: fix panic in accesslist creation (#23225)

* internal/ethapi: revert + fix properly in al tracer

* internal/ethapi: use toMessage instead of creating new message

* internal/ethapi: remove ineffassign

* core: fix invalid unmarshalling, fix test
